If you use a credit card, then you have to take care of some important things. Otherwise you can get into trouble. Some of your understanding can get you out of these difficulties. Because one such case has come to light in which the Delhi Consumer Forum has imposed a fine of Rs 2 lakh on SBI Cards and Payments Services Private Limited Company for sending the bill to the customer after the validity of the credit card is over.

The Delhi Consumer Forum, after enquiry, directed the company to pay Rs 2 lakh to the customer for deficiency in service. The customer had complained against the company Cards & Payments Services Pvt Ltd in the consumer forum that his credit card has expired and I have no outstanding bill, yet the company sent me the bill. And harassed again and again to deposit the bill. After this he was put in the list of black list.

Company failed to provide service

The Forum found in its investigation that the company had blacklisted the customer in the CIBIL system for willful defaulters maintained by the RBI, due to which his application for a credit card was rejected from another bank, where he had been with for almost two decades. Regular account was maintained. The Commission is of the view that SBI Cards & Payments Services Pvt. Ltd. has failed to provide services to the complainant and although the damage/loss caused to the complainant in terms of credit rating is yet to be measured in monetary terms.

Further said punitive damages should be ordered against the company, therefore, compensating the complainant by paying an amount of Rs 2 lakh as compensation to the company within two months, failing which a fine of up to Rs 3 lakh have to give. The forum passed the order on May 20 on a complaint by a customer seeking compensation, who claimed that he had requested the company to cancel and not renew his card before its expiry in April 2016.

Card not used since 2016

Customer states that the card has not been used for any transaction after April 9, 2016 and has destroyed the card as per rules. There was also no payment outstanding on the card at that time. In September the complainant received a letter from the company regarding cancellation of his card, however, the company continued to send bills related to the card. Ignored his protest e-mail. The bills till May 18, 2017 were Rs 2,946, which included late payment fee and penalty.

The company had warned

The company had warned the customer to pay the bill or else it would “adversely impact the credit score maintained by the credit bureaus and may hinder future credit requirement. The company further blacklisted them in the CIBIL system of willful defaulters maintained by the RBI and they faced trouble in getting loans or credit cards. During the arguments, the company denied the allegations. After this the customer was forced to complain.
